Serious Injury Manual updated.

The College’s Serious Injury Manual has been updated to reflect recent case decisions in multiple areas, including:

  • discussion of the procedural consequences for a serious injury claim when an employer rejects liability
  • economic loss, including the differences between assessing post-injury earning capacity and assessing of damages
  • additional commentary on the issue of disentangling, where a mental impairment arises from the traumatic circumstances of the incident, rather than the associated physical injuries
  • discussion of the scope of the indemnity for claims ‘arising out of the use’ of a motor vehicle
  • assessing pain and suffering, including the requirement to assess impacts both individually and holistically
