Serious Injury Manual updated

We have made changes to several chapters of our Serious Injury Manual to reflect the latest updates to the law on legal proceedings for workplace or transport accident injuries.

Chapters on the meaning of serious injury, economic loss and credibility have been updated as part of our regular review of new Victorian cases and legislation, such as Samaras v TAC [2019] VSCA 255, VWA v Sapalovski [2019] VSC 851 and Maimonis v Bourke [2019] VSCA 302.

Most notably, we have made updates regarding:

  • Assessing serious injury in transport accident cases;
  • Identifying when an injury arises in the course of employment;
  • The interaction between witness credit, medical evidence and proof of a serious injury.
