Welcome to the latest update in Scholarship for the Legal Community: a curated selection of research summaries of recently published academic writing from local and international journals.
Seven new pieces of research have been added to the collection, including:
- An analysis of recurring issues in civil appeals including the raising of points for the first time on appeal
- An alternative justification for the 'principle of legality' which enables the courts to use the common law to find statutory meaning
- An analysis of the importance of judges describing their moral reasoning in minimising the risk of unconscionable conduct arising in private law transactions
