Mental Health Royal Commission report released.

The Royal Commission into Victoria’s Mental Health System has released its comprehensive review of the mental health system and services throughout Victoria.

We take note of the Royal Commission’s consideration of the intersection between mental health and the courts, with an explicit recognition that people living with mental illness are over represented throughout the criminal justice system. The College continues to develop education events and resources directed at providing judicial officers with a better understanding of the complex challenges mentally ill offenders may face, including how a person’s mental illness should be considered at the time of sentence.

Our forthcoming webinar, ‘Sentencing: What’s in a name?’, will explore the implications of the Court of Appeal's decision in Brown v The Queen [2020] VSCA 212, where the Court considered how personality disorders should be taken into account at sentencing.
