A new chapter on enduring powers of attorney has been added to the Guide to the Guardianship and Administration Act 2019.

The new chapter explains the operation of enduring powers of attorney under the Powers of Attorney Act 2014 (Vic) ('Act') and incorporates VCAT cases that interpret provisions of that Act. Key areas covered in the chapter include:

  • the making and ending of an enduring power of attorney
  • attorney's duties under the Act
  • VCAT's powers under the Act
  • revocation of old enduring powers of attorney made under repealed provisions of the Instruments Act 1958, Guardianship and Administration Act 1986, and Medical Treatment Act 1988
