Charter Case Collection: Recent Updates

Developed in collaboration with the Supreme Court of Victoria, this publication includes summaries of all significant Charter cases decided by the Supreme Court of Victoria from 2007 to 2015.

The publication now includes the following important Charter cases:

  • Bare v IBAC [2015] VSCA 197 on the obligation of public authorities to consider Charter rights when making decisions, and the scope of the right not to be treated or punished in a cruel, inhuman or degrading way; and
  • Carolan v R [2015] VSCA 167 and Kuyken v Chief Commissioner of Police [2015] VSC 204, which deal with the Charter’s effect on statutory interpretation.
