The following flowcharts provide a visual representation of the decision making process used when deciding an application for bail.

  • Decision-Making Flowchart for Bail Applications – Note: This chart will no longer accurately reflect the bail decision making process after the Bail Amendment (Stage One) Act 2017 (Vic) commences on 21 May 2018.

  • Decision-Making Flowchart for Bail Applications - Note: This chart reflects the new bail decision making process effective from 21 May 2018.  Although the flowchart cites some provisions of the Bail Act 1977 (Vic) that will not be in effect until the Bail Amendment (Stage Two) Act 2018 (Vic) commences on 1 July 2018, the chart accurately reflects the process as introduced by Bail Amendment (Stage One) Act 2017 (Vic). The JCV has prepared only one flowchart to avoid circulating two charts, one of which that would contain references to provisions that will be re-numbered, and so be inaccurate, after little more than a month.
