Important changes to family violence and personal safety

The College’s Family Violence and PSIO resources have been updated to reflect the second tranche of amendments from the Justice Legislation Amendment (Family Violence Protection and Other Matters) Act 2018.  

The amendments commence today and involve:

  • introducing the ‘Declaration of Truth’ and amending the penalty for false certification;
  • adjusting evidentiary requirements for interim orders made by electronic communication;
  • abolishing appeals against interim orders;
  • modifying applications to vary or revoke an interim order; and
  • clarifying the court’s power to make interim orders.

The relevant sections in the Family Violence Bench Book and the Personal Safety Intervention Order Bench Book have been updated.   

We have also made amendments to the Family Violence and PSIO checklists.
