Upcoming Commercial CPD Seminar on 'Abuse of Process'

Commercial CPD Seminar (Abuse of Process)

Wednesday 15 November 2017, 5.15pm-6.15pm Monash University Law Chambers, 555 Lonsdale St, Melbourne

All courts have jurisdiction to prevent their processes from being used as an instrument of oppression or otherwise misused. In the same vein, practitioners are obliged to refrain from bringing proceedings or conducting litigation where to do so would amount to an abuse of process.

While a decisive response to frivolous and improper claims is vital to minimising the expense and distraction that they can cause, the most obvious response is not always the best strategic solution. Similar considerations come into play when responding to inappropriate applications and other steps taken in the conduct of otherwise appropriate claims.
